FEMICIDIO DE ANAHÍ BENITEZ: CONDENARON A MARCOS BAZÁN

El Tribunal Oral Criminal N°7 de Lomas de Zamora condenó este miércoles a Marcos Esteban Bazán por el femicidio de Anahí Benítez , la joven de 16 años asesinada en 2017 en Lomas de Zamora. En el marco de un proceso que desde el inicio presentó muchas dudas y sin profundizar las pistas que, a través de testigos protegidos, indicaban que la víctima habría sido secuestrada por un grupo de hombres vinculados a redes de narcotráfico y trata del barrio Parque Barón.

Si bien el Tribunal compuesto Elisa López Moyano, Roberto Conti y Roberto Lugones por no detalló la pena que recibirá Bazán, que será informada el 2 de junio, todo parece indicar que, si la culpabilidad es confirmada por los delitos de «privación ilegal de la libertad agravada, homicidio agravado por alevosía, criminis causa y por mediar violencia de género» y de «abuso sexual agravado por acceso carnal» -tal como solicitaron el fiscal Hugo Carrión y Guillermo Bernard Krizan, abogado de la madre de Anahí,-, Bazán sería condenado a prisión perpetua.

La condena se basa en la hipótesis del fiscal, quien asegura que Bazán conocía a Anahí y que se habría aprovechado de su confianza para secuestrarla, junto a Villalba, el 29 de julio de 2017. Carrión afirma que la joven fue retenida y drogada en la casa de Bazán en la Reserva de Santa Catalina, abusada por Villalba y luego asesinada por los dos hombres. Todo esto se asienta en el rastrillaje del perro «Bruno», realizado el 7 de agosto, tres días después de que el cadáver apareciera a 235 metros de la casa de Bazán. Ese día el perro siguió el rastro de la ropa de la joven hasta el domicilio del acusado, donde se le hizo olfatear la funda de su almohada y, al seguir este olor, llegó al foso donde el cuerpo había sido hallado. En su alegato, Carrión aseguró que Bruno participó en más de 200 rastrillajes exitosos.

Sin embargo, el planteo que la defensa opuso a esta prueba no se basa en el olfato del perro, sino en el material que se le dio a olfatear. Según aseguró en su alegato Rosario Fernández, quien lleva adelante la defensa junto a Eduardo Soares, ambos de la Asociación Gremial de Abogados, en el rastrillaje se incumplió la «cadena de custodia». La prenda de Anahí fue entregada un día antes del operativo al adiestrador de Bruno, quien la retuvo sin custodia policial hasta el día siguiente. Además, Soares sostuvo que al hallarse el cuerpo el foso se convirtió en «zona liberada, sin resguardo, cualquiera pudo ir y venir».

Más allá del rastrillaje, Fernández y Soares apoyaron su defensa en la ausencia de pruebas para afirmar que Bazán conociera a Anahí o a Villalba. En el caso de este último, de los más de cien testigos presentados solo una mujer sostuvo que un familiar le dijo que «Villalba vendía droga en la casita del bosque», en referencia a la casa de Bazán. El resto de los testigos no dio indicios de los vínculos y de los testimonios de los amigos de Anahí se desprende que nunca conoció a Bazán. 

En este sentido, la Gremial de Abogados denunció que, a lo largo del debate, los jueces «apretaron, amenazaron y hostigaron a los compañeros de Anahi que repetían que no conocía a Bazán», según aseguraron en un comunicado. Ahora la defensa sostiene una recusación contra el Tribunal en la Cámara de Casación Penal de La Plata. Fernández confirmó a Página/12 que, si esto avanza, “podría volverse a hacer el juicio”. 

Marcelo Villalba

El juicio por el femicidio de Anahí se cierra sin condena para el principal imputado. Villalba, de quien se halló ADN en rastros de semen del cadáver, alegó en la primera jornada que sufría problemas psicológicos. Entonces, cuatro peritos diagnosticaron que el hombre tenía una «estructura psicótica» y no estaba en condiciones de seguir el juicio.  

En la misma jornada, la madre de Anahí dio testimonio frente al Tribunal. Allí, entre otras cosas, indicó que a fines de 2017 un testigo se presentó en su casa del barrio Parque Barón para decirle que a «Anahí la llevaron a la casa de un tal ‘gordo maní’, que fue drogada, violada y llevada a la Reserva. Villalba estuvo en esa casa”. Además, el testigo indicó que del hecho participaron al menos cinco hombres, entre los cuales no ubicó a Bazán. El testigo fue incorporado al caso con nombre reservado y se realizaron algunos peritajes.

Sin embargo, en la causa contra Bazán y Villalba, la pista no fue seguida. Por el contrario, se abrió una investigación en la UFI 2, a cargo de Fabiola Juanatey y Verónica Pérez, que según fuentes judiciales avanza pero sin información oficial sobre su desarrollo. Ahora, Villalba será revisado cada tres meses para saber si está en condiciones de ser juzgado. Mientras tanto, su palabra clave sigue ausente. 

Parque Barón 

Al momento del femicidio de Anahí, Villalba era señalado como el dealer de Parque Barón. En diciembre de 2017, la Comisaría 9° de ese barrio fue allanada por una investigación de coimas, de redes de trata y narcotráfico. La 9° de Barón fue la encargada del operativo de búsqueda de Anahí. Durante los seis días que la joven estuvo desaparecida, su madre denunció fallas en la búsqueda con una excesiva atención en investigar a la familia. Finalmente, el cadáver apareció en un lugar que ya había sido rastrillado, en un foso de 40 centímetros, «a flor de tierra», según palabras del abogado Soares. De esos días no existen registros de las cámaras de seguridad de la zona: estaban apagadas.

El 5 de agosto de 2017, Leonardo Agostino, profesor de Anahí en la Escuela Normal Antonio Mentruyt de Banfield (ENAM), fue detenido a las apuradas y sin pruebas. Debió ser liberado a los tres días luego de que el perro Bruno no lo señalara. Según se ve en los videos de los rastrillajes -que fueron editados-, el ladrido que Bruno dirige a Agostino no se distingue del que luego serviría para acusar a Bazán.  

«¿Quién secuestró a Anahí? ¿Dónde estuvo cautiva? ¿Cómo la llevaron hasta donde la enterraron? ¿Qué le hicieron? ¿Qué pasó con su violador que no está presente desde el inicio del juicio? ¿Por qué las cámaras de seguridad estaban desactivadas? ¿Por qué se pasa por encima que la 9° fue culpada por redes de trata?», son las preguntas que hace Quimey Barrera, vicepresidenta del Centro de Estudiantes del ENAM, que junto a otras organizaciones feministas y de derechos humanos se movilizaron a los Tribunales de Lomas de Zamora para pedir que no se cierre la causa y que se reabra la investigación.
